Give A Hand may not be used in connection with any fundraising activity that in general:
- Violates any law or government regulation, or promotes or facilitates such action by third parties.
- Is fraudulent, deceptive, unfair or predatory.
- Causes or threatens to damage Give A Hand’s reputation.
- Violates the terms of any bank, card or electronic funds transfer network.
- Results in or creates a significant risk of chargebacks, penalties, damages or other harm or liability.
Give A Hand has developed our Prohibited Conduct Policy to prevent any abuse as outlined above and to protect our users from conduct that may cause harm to their experience of using Give A Hand or abuse any features of our Service.
By using our Service, you agree to follow the rules and manners as included in our Help Center articles and in our Terms and Policies. By using our Service, you agree not to engage in the following Prohibited Conduct:
- Using the Service for any illegal purpose or in violation of any local, state, national, or international law or regulation; violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third party intellectual property right;
- Posting, uploading, or distributing any User Content or other content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could consider objectionable, profane, indecent, pornographic, harassing, threatening, embarrassing, hateful, offensive or otherwise inappropriate;
- Interfering with security-related features of the Service, including by: (a) disabling or circumventing features that prevent or limit use or copying of any content; or (b) reverse engineering or otherwise attempting to discover the source code of any portion of the Service except to the extent that the activity is expressly permitted by applicable law or regulation;
- Interfering with the operation of the Service or any user’s enjoyment of the Service, including by: (a) uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code; (b) making any unsolicited offer or advertisement to another user of the Service; (c) attempting to collect, personal information about another user or third party without consent; or (d) interfering with or disrupting any network, equipment, or server connected to or used to provide the Service, or violating any regulation, policy, or procedure of any network, equipment, or server; use any robot, spambot, spider, crawler, scraper or other automated means or interface not provided by us to access the Service or to extract data;
- Performing any fraudulent activity including impersonating any person or entity, claiming a false affiliation to an organization, creating account of another person or accessing any other Service Account without permission, or falsifying your age, date of birth, tax identification or last four digits of social security number or other information provided to Give A Hand;
- Selling or otherwise transferring the access granted under these Terms or any right or ability to view, access, or use any Material.
Give A Hand may take any of the following actions on an account that has violated our Policies or if Give A Hand suspects prohibited conduct has occurred:
- We may contact Users or utilize a third party verification service to verify a User, an account or fundraiser information.
- Give A Hand may remove fundraiser(s) at its discretion for any reason, refuse a user access to or suspend a user from all or part of the Service until the completion of such verification.
- Give A Hand may prohibit a user that is terminated for engaging in any prohibited conduct from using and accessing any future services provided by Give A Hand.
- Give A Hand may hold funds after a suspension or termination to cover chargeback/funds reversal risk or refunds arising from Prohibited Conduct as stated in our Terms of Service.
We may update our list of Prohibited Conduct from time to time. The following is a list of actions Give A Hand restricts users from participating in:
Fundraising:
- Fundraisers that engages in, encourages, promotes or celebrates unlawful violence or physical harm to persons or property, or b. engages in, encourages, promotes or celebrates unlawful violence toward any group based on race, religion, disability, gender, sexual orientation, national origin, or any other immutable characteristic.
- Fundraisers that involve Illegal drugs, substances designed to mimic illegal drugs, and equipment designed for making or using drugs.
- Using Give A Hand for the purpose of money laundering.
- Using Give A Hand to donate and withdraw from yourself or to send funds to yourself.
- Using Give A Hand for the purpose of misleading others to receive funds.
- Creating multiple fundraisers listings of the same fundraiser.
- Using photos and or other content that you do not own or have not taken yourself or have not taken permission to use such content.
- Using pornographic and other mature audience content (including literature, imagery and other media) depicting nudity or explicit sexual acts.
- Using another member's fundraiser information or words without their consent.
- Using another user’s personal information in a manner other than specified by Give A Hand.
- Creating a fundraiser in auction, raffle, or giveaway format (such fundraisers might be regulated and might require local authority permits or approvals).
- For charity fundraising — having prior confirmation from the charity/organization you are fundraising on behalf of them.
- Fundraisers involving guns and firearms or the direct offer of financial products including debt, equity or profit shares.
- Fundraisers whose purpose is to promote/incite hate or disrespect of religions or atheism.
If you're unsure if your fundraiser is well suited for our platform, please get in touch with us via our Help Center prior to creating a fundraiser to avoid any suspensions or holds of funds.
Accounts:
- Providing Give A Hand or our payment processor manipulated, inaccurate, or misleading information regarding your identity, the nature of the fundraiser, and any other information requested (you must inform us immediately of any changes to your personal information).
- Having multiple Give A Hand accounts without significant purpose.
- Creating a new account after being limited or permanently banned.
- Creating a new account to bypass restrictions on another account.
- Impersonating another person or other accounts in your user name or fundraiser description.
- Providing false information when registering for or validating any account information.
- Providing Give A Hand or our payment processor manipulated, inaccurate, or misleading information regarding your identity, the nature of the fundraiser, and any other information requested (you must inform us immediately of any changes to your personal information).
Other:
- Threats
- Slander
- Trolling
- Indecent behavior
- Spamming
- Copyright infringement
- Posting false information
- Spreading negativity
